Terms and Conditions

These Terms and Conditions ("Terms", "Terms of Service") govern your access to and use of the MapInch website, web application, mobile applications, map viewer, geographic information services, and related features and services (collectively, the "Platform").

The Platform is operated by MapInch LLP ("MapInch", "we", "us", or "our").

By accessing, registering for, or using MapInch, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, you should not access or use the Platform.

1. About MapInch

MapInch is a digital mapping and geographic information platform designed to help authorized users view, search, manage, explore, and work with village maps, land maps, geographic information, cadastral information, spatial layers, and related records.

MapInch is intended primarily for government departments, organizations, professionals, survey and GIS users, and other authorized users.

MapInch provides software, technology, and infrastructure for accessing and managing geographic information.

Unless expressly stated otherwise, MapInch does not itself certify, verify, determine, or guarantee:

• Land ownership or title;
• Legal rights over land;
• Property boundaries;
• Cadastral accuracy;
• Survey measurements;
• Legal validity of land records;
• Governmental or statutory status of information displayed through the Platform.

Users should refer to applicable official records and authorities where legal or official verification is required.

2. Acceptance of Terms

By creating an account, accessing the Platform, or using any MapInch service, you agree to comply with these Terms and any additional terms applicable to specific features or services.

If you are using MapInch on behalf of a department, organization, company, or other entity, you confirm that you have the authority to accept these Terms on behalf of that entity.

These Terms, together with the MapInch Privacy Policy and any applicable service-specific terms, form the agreement governing your use of MapInch.

3. Eligibility and Authorized Use

You may use MapInch only where you are legally permitted to enter into these Terms and use the Platform.

MapInch is intended primarily for professional, organizational, governmental, administrative, surveying, mapping, GIS, land-management, and related purposes.

You are responsible for ensuring that your use of MapInch complies with:

• Applicable laws and regulations;
• Government or departmental requirements;
• Organizational policies;
• Data access restrictions;
• Any permissions applicable to the information you access or upload.

4. Account Registration

Certain MapInch features require an account.

During registration, you may be required to provide information including:

• Name;
• Email address;
• Mobile number;
• Department;
• Designation;
• Other information required for account creation or verification.

You agree to provide information that is accurate, current, and complete.

You must update your account information where necessary to keep it accurate.

MapInch may use the IP address associated with registration to determine an approximate location such as city, state, or country, as described in the Privacy Policy.

5. Account Security

You are responsible for maintaining the confidentiality and security of your account credentials.

You must not:

• Share your password or authentication credentials with unauthorized persons.
• Allow unauthorized persons to use your account.
• Attempt to access another user's account.
• Share authentication tokens or private access links.
• Attempt to bypass authentication or authorization controls.

You must notify MapInch if you believe your account has been compromised or accessed without authorization.

MapInch may temporarily restrict an account where reasonably necessary to investigate or prevent unauthorized access, security threats, fraud, misuse, or violations of these Terms.

6. Acceptable Use

You agree to use MapInch only for lawful and authorized purposes.

You must not:

• Use the Platform for unlawful, fraudulent, or unauthorized activities.
• Attempt to gain unauthorized access to MapInch systems or accounts.
• Circumvent security or access-control mechanisms.
• Interfere with or disrupt Platform operations.
• Introduce malware, viruses, malicious code, or harmful software.
• Attempt to reverse engineer, decompile, or extract source code from the Platform except where permitted by applicable law.
• Scrape, copy, harvest, or systematically extract Platform data without authorization.
• Use automated systems to place unreasonable load on the Platform.
• Misrepresent your identity, department, organization, or authority.
• Use another person's account without authorization.
• Upload content that you do not have the right or authorization to use.
• Violate the intellectual property, privacy, confidentiality, or other rights of another person or organization.
• Redistribute protected MapInch maps or documents without authorization.

7. Maps and Geographic Information

MapInch may provide maps, village information, administrative information, cadastral information, Mustil and Killa information, parcel information, geographic coordinates, spatial layers, and other geographic records.

Information available through MapInch may originate from users, authorized organizations, government sources, public sources, third-party sources, or other data providers.

MapInch does not guarantee that geographic information is:

• Complete;
• Accurate;
• Current;
• Error-free;
• Legally authoritative;
• Suitable for a particular purpose.

Geographic information displayed through MapInch should not automatically be treated as an official land record, legal document, survey record, title document, or authoritative determination of ownership or boundaries.

Where accuracy or legal validity is important, users should verify the information against the applicable official records, authorities, documents, surveys, or other authoritative sources.

8. User-Uploaded Data and Content

Depending on your account and available features, you may upload, submit, store, manage, or otherwise provide maps, documents, geographic data, spatial files, records, and other content ("User Content").

You retain ownership of your User Content unless otherwise agreed separately with MapInch.

By uploading User Content, you represent and warrant that:

• You have the necessary rights, permissions, licenses, or authority to upload and use the content.
• Your use of the content does not violate applicable laws.
• Your use of the content does not violate the rights of another person or organization.
• You have authority to permit MapInch to process the content for providing the applicable services.

You grant MapInch the limited right to store, process, transmit, display, convert, render, and otherwise handle User Content as reasonably necessary to provide, maintain, secure, and operate the relevant MapInch services.

Uploading content to MapInch does not transfer ownership of that content to MapInch.

9. Protected Maps, Documents, and Geographic Data

Certain maps, documents, geographic records, and other resources available through MapInch may be private, restricted, or accessible only to authorized users.

Access to protected resources may be controlled through:

• Authentication;
• Authorization;
• Role-based permissions;
• Temporary access mechanisms;
• Signed or access-controlled URLs;
• Other security mechanisms.

You must not attempt to bypass these controls or access resources that you are not authorized to access.

You must not publish, redistribute, sell, or share protected maps, documents, or geographic information with unauthorized persons.

You are responsible for ensuring that any person to whom you provide downloaded or otherwise accessible information is authorized to receive it.

10. Downloaded Maps and Files

MapInch may provide a feature that allows users to download maps, documents, geographic data, or associated files for later use.

Downloaded files may be stored on the user's device or otherwise made available through the user's device.

Downloading a map or file does not transfer ownership of the content to the user and does not provide rights beyond the permissions applicable to that content.

Users are responsible for maintaining the security of downloaded files.

You must not redistribute, sell, publish, or commercially exploit downloaded maps or files where you do not have the necessary rights or authorization.

The MapInch Download feature does not constitute an offline mode. Certain MapInch functionality may require an active internet connection and communication with MapInch services.

11. Intellectual Property

The MapInch Platform and its proprietary components, including software, interface, design, branding, logos, text, graphics, functionality, and related materials, are owned by or licensed to MapInch LLP and are protected by applicable intellectual property laws.

Except as expressly permitted, you must not:

• Copy or reproduce the Platform;
• Modify or create derivative works from the Platform;
• Redistribute or resell the Platform;
• Reproduce MapInch branding without authorization;
• Remove proprietary notices;
• Use MapInch software or proprietary materials for unauthorized commercial purposes.

These Terms do not transfer ownership of MapInch intellectual property to you.

12. Third-Party Services

MapInch may use third-party services to support functions such as:

• Cloud infrastructure;
• File and data storage;
• Payment processing;
• Communications;
• Security;
• Application operations;
• Monitoring;
• Other infrastructure or operational services.

Certain Platform features may also depend on third-party services or data sources.

Your use of third-party services may be subject to their own terms, policies, and conditions.

MapInch is not responsible for the independent operation, availability, policies, or practices of third-party services.

13. Subscriptions and Payments

Certain MapInch features or services may require a paid subscription.

Where applicable:

• Subscription plans and prices will be displayed before purchase.
• Payments may be processed through third-party payment providers.
• Your subscription status may depend on successful payment processing.
• Access to paid features may be restricted or suspended if a subscription expires, is cancelled, or payment fails.
• Subscription changes, renewals, cancellations, and refunds may be subject to the terms presented for the applicable plan.

Where a third-party payment provider processes your payment, its applicable terms and policies may also apply.

14. Subscription Changes and Cancellation

Depending on the subscription plan and features available, MapInch may allow users to upgrade, downgrade, renew, or cancel subscriptions.

Where a change is scheduled for a future billing period, the existing subscription may remain active until the scheduled change takes effect.

Cancellation of a subscription does not necessarily delete the user's MapInch account.

Unless otherwise stated in the applicable plan terms, cancellation may affect access to paid features at the end of the applicable subscription period.

15. Service Availability

MapInch aims to provide reliable and secure services but does not guarantee that the Platform will always be available, uninterrupted, or error-free.

The Platform may become temporarily unavailable because of:

• Scheduled maintenance;
• Emergency maintenance;
• Security measures;
• Infrastructure failures;
• Network issues;
• Third-party service interruptions;
• Software updates;
• Events beyond our reasonable control.

MapInch may modify, update, suspend, or discontinue particular features or services where reasonably necessary for operational, technical, security, legal, or business reasons.

16. Maintenance and Security Updates

MapInch may temporarily restrict access to the Platform or specific features to perform:

• Scheduled maintenance;
• Emergency maintenance;
• Security updates;
• Infrastructure upgrades;
• Database or system maintenance;
• Application updates.

Where reasonably practical, MapInch may provide advance notice of planned maintenance.

Emergency maintenance or security restrictions may occur without advance notice where necessary to protect users, data, or Platform infrastructure.

17. Privacy

Your use of MapInch is also governed by the MapInch Privacy Policy.

The Privacy Policy explains how MapInch LLP collects, processes, stores, uses, and protects personal information, technical information, geographic information, and other information processed through the Platform.

By using MapInch, you acknowledge that information may be processed in accordance with the Privacy Policy.

18. User Responsibility for Data

You are responsible for information, maps, documents, geographic records, and other content that you upload, submit, manage, download, or use through MapInch.

You are responsible for ensuring that:

• You have the necessary rights and authorization to use the data.
• You do not upload confidential or restricted information unless you are authorized to do so.
• Your use of the data complies with applicable laws and organizational requirements.
• Important information is appropriately retained or backed up where necessary.
• You use geographic and land-related information appropriately for its intended purpose.

MapInch is not responsible for errors, omissions, inaccuracies, or legal restrictions associated with User Content supplied by users or third parties.

19. Professional and Government Use

MapInch may be used in professional and administrative workflows involving:

• Revenue departments;
• Irrigation departments;
• Land Records departments;
• Survey and GIS professionals;
• Infrastructure teams;
• Planning departments;
• Government officers;
• Other authorized professional users.

MapInch provides technology to support such workflows and does not independently replace:

• Official government records;
• Statutory authorities;
• Legal advice;
• Professional surveying;
• Engineering verification;
• Land-title verification;
• Official cadastral procedures;
• Other legally required processes.

Users remain responsible for obtaining appropriate professional or official verification where required.

20. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MapInch provides the Platform on an "as is" and "as available" basis.

MapInch does not warrant that:

• The Platform will always be available or uninterrupted.
• The Platform will always be error-free.
• Geographic information will always be complete or accurate.
• Maps or documents will remain available indefinitely.
• The Platform will satisfy every particular user requirement.
• Information obtained through the Platform will be suitable for every intended purpose.
• Third-party services or data sources will always be available or accurate.

Users should independently verify information where accuracy, legal validity, financial consequences, land ownership, boundaries, surveying, engineering, or other important decisions are involved.

21. Limitation of Liability

To the maximum extent permitted by applicable law, MapInch LLP and its owners, partners, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, consequential, special, or exemplary damages arising from or related to the use of, or inability to use, the Platform.

This may include losses arising from:

• Loss of data;
• Loss of business;
• Loss of revenue;
• Loss of opportunity;
• Service interruption;
• Reliance on inaccurate or incomplete information;
• Unauthorized access resulting from circumstances outside reasonable security controls;
• Third-party services or systems.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

22. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MapInch LLP, its partners, employees, affiliates, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your violation of these Terms;
• Your unauthorized use of the Platform;
• Your User Content;
• Your violation of another person's or organization's rights;
• Your violation of applicable laws or regulations;
• Your misuse of maps, documents, or geographic information obtained through the Platform.

23. Suspension and Termination

MapInch may suspend, restrict, or terminate access to an account or the Platform where reasonably necessary, including if:

• You violate these Terms.
• Your account is used for unauthorized or unlawful activity.
• Your activity creates a security or operational risk.
• Required payments are not completed.
• Access must be restricted for legal or regulatory reasons.
• The relevant Platform service is discontinued.

Where appropriate and reasonably practical, MapInch may provide notice before restricting or terminating access.

Upon termination, your right to use the affected Platform services will cease.

Certain provisions of these Terms may continue to apply after termination, including provisions concerning intellectual property, User Content, liability, indemnification, disputes, and provisions that by their nature should survive termination.

24. Account Deletion

Users may request deletion of their MapInch account, subject to applicable laws, contractual obligations, security requirements, and legitimate retention requirements.

Account deletion may result in the loss of access to:

• Account-related services;
• Subscription features;
• Maps;
• Downloaded or stored Platform information;
• Other information associated with the account.

Information retained in backups or records may remain for a limited period in accordance with applicable retention procedures.

25. Changes to These Terms

MapInch may update these Terms from time to time to reflect changes to:

• The Platform;
• Features and services;
• Subscription plans;
• Security practices;
• Legal or regulatory requirements;
• Business operations.

Updated Terms will be published on the MapInch website with a revised effective date or version where appropriate.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

26. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the applicable laws of India.

Any dispute arising out of or relating to these Terms or your use of MapInch shall be subject to the jurisdiction of the courts having appropriate jurisdiction in India, unless otherwise required by applicable law or agreed separately in writing.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

28. Entire Agreement

These Terms, together with the MapInch Privacy Policy and any additional terms specifically applicable to particular services or subscriptions, constitute the agreement between you and MapInch regarding your use of the Platform.

If there is a conflict between these Terms and specific terms presented for a particular MapInch service, the specific service terms will apply to that service to the extent of the conflict.
